This Privacy Policy explains how Wasabi Commerce LLC ("Sell Wasabi", "we", "us", "our") collects, uses, shares and protects personal information when you visit sellwasabi.com (the "Site") or use our services.

We act as a commercial intermediary. We help owners of e-commerce and direct-to-consumer businesses prepare their business for sale and introduce them to parties who may be interested in acquiring it. Because of that, the information we handle often includes commercially sensitive business information as well as personal information.

Information we collect

Information you give us directly

When you complete a valuation enquiry, book a call, or otherwise contact us, we may collect:

• Your name
• Your email address
• Your phone or WhatsApp number
• The URL and name of your business
• Revenue, profit, traffic, and other financial or operational information about your business
• Information about your reasons for selling, your timeline, and your expectations
• Any other information you choose to send us in correspondence

If you engage us on a mandate, we will collect substantially more detail, including financial statements, platform analytics, supplier and customer information, and similar records. That information is handled under the terms of our engagement agreement and any non-disclosure agreement between us, in addition to this Policy.

Information collected automatically

When you visit the Site we and our service providers may collect:

• IP address and approximate location derived from it
• Browser type, device type, and operating system
• Pages viewed, time on page, and referring URL
• Advertising identifiers and click identifiers, including the Meta click ID (fbclid) where you arrive from an advertisement
• Campaign parameters such as utm_source, utm_campaign and utm_content

Information from third parties

We may receive information about you from advertising platforms, public business directories, marketplace listings, and similar sources, where you or your business have a public presence. We may combine that with information you give us.

The Site uses cookies and similar technologies, including the Meta Pixel operated by Meta Platforms, Inc.

The Meta Pixel collects information about your visit, including pages viewed and actions taken, and shares it with Meta. Meta may use this to measure the effectiveness of our advertising, to show you advertisements for our services on Facebook and Instagram, and to build audiences of people similar to our visitors. Meta may process this information in accordance with its own data policy.

Categories of cookies we use:

• Strictly necessary — required for the Site to function. These cannot be switched off.
• Analytics — help us understand how the Site is used.
• Marketing and advertising — used to measure and target advertising, including the Meta Pixel.

Who we share your information with

Disclosure to these parties is a necessary part of the service. We take reasonable and customary precautions, which may include presenting the opportunity on an anonymised basis in the first instance and seeking confidentiality undertakings where we consider it appropriate. We do not publish or publicly disclose the identity of businesses that enquire with us.
• Service providers that operate our infrastructure, including:
  • Webflow, Inc. — website hosting
  • Typeform SL — hosting of our enquiry and valuation forms
  • Close (Elastic Inc.) — customer relationship management
  • Meta Platforms, Inc. — advertising and measurement
  • Google LLC — email, documents and calendar
  • Payment, accounting and e-signature providers used to administer engagements
• Professional advisors — lawyers, accountants and insurers, where necessary.
• Authorities — where we are required to disclose information by law, court order, or to protect our rights.
• A successor — if our business is sold, merged or reorganised, information may transfer as part of that transaction.

International transfers

We are established in the United States and our service providers operate in the United States and elsewhere. If you are located in the European Economic Area or the United Kingdom, your personal information will be transferred outside your jurisdiction.

Where we make such transfers we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum, or on a derogation such as the necessity of the transfer for the performance of a contract with you.

How long we keep your information

We keep enquiry information for as long as needed to respond to you and for a reasonable period afterwards in case you re-engage, ordinarily up to 36 months from your last interaction with us.

Where we have acted on a mandate, we keep transaction records for at least seven years from completion, to meet legal, tax and professional obligations.

We may keep information for longer where we are required to do so by law or where it is needed to establish, exercise or defend legal claims.

Under the California Consumer Privacy Act as amended, you have the right to know what personal information we collect and how we use and disclose it, to request deletion, to request correction, and not to be discriminated against for exercising these rights.

We do not sell personal information as that term is defined under the CCPA. Our use of advertising cookies may constitute "sharing" for cross-context behavioural advertising. You can opt out through our cookie settings.

Security

Children

Our services are directed at business owners and are not intended for anyone under 18. We do not knowingly collect personal information from children. If you believe a child has given us information, contact us and we will delete it.
